Terms and Conditions

Welcome to Himalayan Adventure Treks and Tours Pvt. Ltd. (“The Himalayan Treks”). These Terms and Conditions constitute a legally binding agreement between the Company and the Client. By booking a trip with us, you acknowledge that you have read, understood, and agree to comply with the terms outlined herein.

Contractual Relationship

Himalayan Adventure Treks and Tours Pvt. Ltd. (The Himalayan Treks) is a registered entity under the Government of Nepal with Company Registration Number 131922/071/072. The Chief of the Company, Mr. Bhagwat Simkhada, brings over 26 years of expertise in the adventure travel sector. Our head office is located at Thamel Marg -26, Thamel, Kathmandu, Nepal.

Passport and Visa Requirements

Clients are required to carry valid passports and the necessary visas for their destinations. Passports must remain valid for at least six months beyond the trip’s conclusion. The Company assumes no liability for travelers denied entry due to improper or incomplete documentation.

Travel Insurance

Clients must procure comprehensive travel insurance, including medical coverage, air ambulance, and helicopter rescue services. Cancellation insurance is also highly recommended. Proof of insurance must be provided before the trip commences. Failure to present valid insurance documentation will result in prohibition from joining the trip, without entitlement to any refund.

Facilities and Flexibility

Our trips differ significantly from standard holidays and may involve substantial physical demands and inherent risks such as illness, accidents, and unpredictable circumstances. The Company does not assume responsibility for such risks. Clients must exhibit flexibility and be prepared for potential changes in the itinerary, accommodations, and transport due to unavoidable circumstances. Extra costs incurred due to such amendments will be borne by the clients.

Booking and Payment

Booking Process: To book a trip, complete the Booking Application Form and submit it with a non-refundable deposit of 25% of the total trip cost (50% for Tibet and Bhutan trips). The remaining balance (75% for Nepal trips and 50% for Tibet and Bhutan trips) is payable upon arrival in Kathmandu before the trip’s start.

Payment Methods: Payments can be made via Bank Transfer or Credit Card (MasterCard, Visa, Union Pay, JBC, SCT Card). Credit card payments incur a 4% surcharge. Balance payments must be made in cash before departure.

Cancellation Policy

Customer-Initiated Cancellation: No refunds will be issued for voluntary withdrawal or cancellation after the trip begins. No refunds or reuse for unused services such as accommodation, sightseeing, or meals will be provided.

Company-Initiated Cancellation: The Company reserves the right to cancel trips prior to guaranteed departure if the minimum participant requirement is not met or in cases of unforeseen circumstances like natural disasters, strikes, or political instability. In such events, clients may either reclaim 75% of the trip cost (after deducting 13% Government Tax) or apply the amount to an alternative trip within the same year.

Refund Conditions Based on Cancellation Notice:

  • One month before departure: 100% reusable for one year.
  • 15 days before departure: 80% reusable.
  • 7 days before departure: 50% reusable.

Trip Amendment

Amendment requests made 60 days before departure incur a USD 50/person fee. Requests within 60 days will follow the cancellation policy. Additional administration fees apply for changes to hotels, transfers, or additional services.

Health Conditions

Clients must provide a medical certificate confirming their fitness for the trip. The Company must be informed of any medical conditions during booking. Clients bear all medical and evacuation expenses. It is recommended to consult a doctor for a thorough health check-up and necessary vaccinations before booking.

Weather and Unfavorable Conditions

Mountain weather can be unpredictable, possibly leading to flight delays or cancellations. The Company will cover accommodation and food costs during such delays until alternative arrangements are made. However, clients are responsible for additional charges incurred due to missed international flights or altitude sickness. The Company will assist in making necessary arrangements, but costs will be covered by clients.

Governing Law

All agreements and contracts between the client and the Company are governed by Nepalese law. Amendments to these terms can only be made in writing by the Chief of the Company.
